被処分者は、彦根市地先における民間工事（以下、本件工事という）において、建設業法第３条第1項の規定に違反し建設業の許可を受けないで建設業を営む者と、下請契約を締結した。 このことは、同法第28条第1項第6号に該当すると認められる。 また、本件工事は同法第26条第3項に違反し、技術者の専任を要する建設工事であるにもかかわらず、主任技術者を他の工事の主任技術者として配置していた。 このことは、同法第28条第1項第2号に該当すると認められる。 加えて、同法第7条第2項および同法第26条第３項に違反し、営業所の専任の技術者が専任を要する本件工事の主任技術者として配置されていた。 このことは、同法第28条第1項第2号に該当すると認められる。 さらに、同法第19条に違反し、本件工事の下請け契約において、契約の締結に際して交付すべき書面を交付していなかった。 このことは、同法第28条第1項柱書に該当すると認められる。
