当該建設業者は、兵庫県内の民間発注の工事（以下「本件工事」という。）において、建設業法第３条第１項の規定に違反して電気工事業（本件工事が建築一式工事である場合にあっては建築工事業）に係る同項の許可を受けないで建設業を営む株式会社ミサワと下請契約を締結した。 また、同社が請け負った本件工事が建築一式工事でない場合にあっては、当該建設業者は、発注者から直接その工事を請け負った特定建設業者以外の建設業を営む株式会社ミサワと下請代金の額が同条第１項第２号の政令で定める金額以上となる下請契約を締結した。
