当該建設業者は、大阪市発注の複数の工事において、建設業法第３条第１項の規定に違反して、建築工事業又は鋼構造物工事業に係る同項の許可を受けないで請負代金の額が建設業法施行令第１条の２に定める金額以上となる建設工事を請け負い、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む者と下請契約を締結した。 また、当該建設業者は、上記の工事の一つにおいて、建設業法第22条第２項の規定に違反して、あべの建設株式会社から同社が請け負った建設工事の主たる部分を一括して請け負った。
