株式会社加藤工業は令和４年６月28日、東京都港区内の新築工事現場において、職長であった労働者が最大荷重2.2トンのフォークリフトを無資格で運転をした。 以上のことが、労働安全衛生法第61条第２項、労働安全衛生法施行令（昭和47年政令第318号）第20条第11号並びに労働安全衛生規則（昭和47年労働省令第32号）第41条に違反し、令和６年９月26日、株式会社加藤工業が罰金刑に処せられた。 このことが、建設業法第28条第１項第３号に該当する。
