当該建設業者は、建設業法第７条第２号に規定する営業所の専任の技術者（以下「営業所の専任技術者」という。）であるA氏が令和元年９月30日に当該建設業者を退社したにもかかわらず、同法第11条第１項及び第４項又は第５項の規定に違反して、同条第１項の変更届書を同日から30日以内に、同条第４項又は第５項の書面を同日から２週間以内に提出せず、また、同条第１項及び第４項の規定に違反して、令和４年7月11日に提出した同条第１項及び第４項の変更届出書及び書面に同月１日に同氏に代えてB氏を営業所の専任技術者として営業所に配置したとの虚偽の記載をした。また、同条第２項の規定に違反して、提出した同項の書類に、令和元年９月１日から令和２年８月31日までの間に請け負った機械器具設置工事の工事現場に配置した主任技術者とは異なる者を当該工事現場に主任技術者として配置したと記載した。
