被処分者は、合計４５６件の居住の用に供する建物の賃貸借の媒介に関して、宅地建物取引士証の失効者に、宅地建物取引業法（以下「法」という。）第３５条の規定に基づく重要事項の説明、及び法第３７条の規定に基づき交付される書面への記名押印を行わせた。この行為は、法第３５条第１項及び第３７条第３項の規定に違反する。 また、事務所に法第３１条の３第１項に規定する専任の宅地建物取引士を置かない状態が継続し、同項の規定に抵触するに至ったにもかかわらず、２週間以内に同項の規定に適合させるための必要な措置を執らなかった。この行為は、法第３１条の３第３項の規定に違反する。 さらに、法第８条第２項に規定する宅地建物取引業者名簿の登載事項のうち、事務所ごとに置かれる専任の宅地建物取引士の氏名に変更があったにもかかわらず、法第９条に規定する変更の届出を３０日以内に行わなかった。この行為は、法第９条の規定に違反する。
