小池建設株式会社は、建設工事業を営み、同社が元請負人として施工した長野県飯田市下久堅小林地内の「飯田市維持修繕工事」の現場において施工及び安全管理を行う事業者であり、かつ事業者Ａから派遣された労働者を指揮命令する事業者である。同社の当時の代表取締役であるＢは、工事現場における施工管理及び安全管理を統括する者である。Ｂは、同工事現場において、令和５年７月10日、事業者Ａから派遣された労働者Ｃが、コンクリート破断作業中に右足部挫創を負った労働災害について、同日から４日以上休業することになったのであるから、所轄の飯田労働基準監督署長に対し、遅滞なく報告書を提出しなければならないのにもかかわらず、令和６年１月16日までこれを提出せず、もって法令の定める報告をしなかった。 このことにより、小池建設株式会社及びＢは労働安全衛生法等違反により各々罰金20万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
