被処分者が依頼者から依頼を受け一団の土地の買取り交渉を行う過程において、被処分者の従業者は、計画地内の土地が依頼者以外の者に売却されて計画地の購入計画が破綻することを恐れ、この売却を阻止する目的で、他人の名義を冒用して架空の売買契約を作出し、偽造の売買契約書及び偽造の売買代金受領書を作成した。さらに、当該従業者はこれらの偽造書類を使用して、依頼者に無断で仮差押命令を申し立て、損害賠償請求訴訟を提訴した。 被処分者は、従業者に対し宅地建物取引業者としてなすべき管理監督を怠り、従業者による不正行為を見逃すなど宅地建物取引業に関し不正又は著しく不当な行為を行った。
