株式会社大萩造園の代表取締役は、法定の除外事由がないのに、令和５年３月16日午後３時30分頃から同日午後４時30分頃までの間、神奈川県愛甲郡愛川町の同社資材置き場内において、産業廃棄物である木くず合計約94キログラムを焼却した。 その結果、廃棄物の処理及び清掃に関する法律違反で、同社に対し罰金70万円、同社代表取締役に対し罰金40万円の罰金刑が確定した（小田原簡易裁判所 令和５年11月21日略式命令）。 このことは、法第28条第１項第３号に該当する。
