被処分者においては、従業者でない者が被処分者の免許名義を使用して宅地建物取引業を営んでいるかの如く名刺に記載して外部に示していることを、当該名刺を受け取った第三者からの情報提供により確認した。被処分者及び名義借用人に事実確認を行った結果、被処分者は当該名刺が使用されることを少なくとも認識していたと判断せざるを得ない。 このことは、法第13条第2項に違反し、法第65条第2項第2号に該当するが、本件については「当該違反行為により関係者の損害が発生せず、かつ、今後発生することが見込まれないとき」に該当すると判断できるため、法第65条第1項による指示処分とする。
