株式会社松建が南伊勢町から請け負った「新桑竈地区海岸水路修繕工事」の現場において、同社代表取締役は、会社の労働者の安全管理を行う必要があるが、架設通路を作業員らに使用させるに当たり、同通路の斜度は25度であったにもかかわらず、同通路に踏桟その他の滑り止めを設けず、機械、器具その他の設備による危険を防止するために必要な措置を講じなかったとして、同社及び代表取締役が、伊勢簡易裁判所から労働安全衛生法違反により、それぞれ罰金２０万円の略式命令を受け、令和６年１１月６日にその刑が確定している。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
