辻󠄀庄商事株式会社の代表取締役は、奈良県奈良市神功２丁目２番地旧神功小学校校舎解体撤去等工事現場において、令和５年１２月１８日、労働者に、深さ約２メートルの掘削構内の杭抜きのための明かり掘削作業を行わせるに当たり、掘削面の土砂の崩落等により労働者に危険を及ぼすおそれがあるのに、あらかじめ土止め支保工を設置するなど危険を防止するための措置を講じないまま、労働者を掘削構内に立入らせ、同構内で労働者に杭抜き作業を行わせた過失により、掘削構内の掘削面が崩壊し、労働者を窒息により死亡させた。 これらにより、同代表取締役は、労働安全衛生法違反および業務上過失致死の罪により、奈良簡易裁判所から、罰金５０万円の略式命令を受け、令和６年９月１３日にその刑が確定した。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
