株式会社プロテクションの役員は、同社の業務に関し、令和４年２月14日に、静岡県掛川市国包の調査作業場所において、労働者が傷害を負い、４日以上休業したものであるから、遅滞なく、労働者死傷病報告書を静岡労働基準監督署長に提出して報告しなければならないのに、令和５年５月12日まで同報告書を提出せず、もって遅滞なく法令で定める報告をしなかった。 この件について、静岡簡易裁判所は令和６年11月29日に同社及び同社の役員に対し、労働安全衛生法違反に基づきそれぞれ罰金20万円の略式命令を行い、これが確定した。 このことは、建設業法第28条第１項第３号に該当するものと認められる。
