有限会社朝日住設は、令和５年６月８日、福山市駅家町助元1204-1に所在する自社ヤード内にて、同会社の労働者がドラグショベルから降車する際に転落して負傷し、４日以上休業したにも関わらず、遅滞なく福山労働基準監督署長に対し労働者死傷病報告書を提出せず、もって法令の定める報告をしなかった。 このことにより、同社及び同社の代表取締役は、福山簡易裁判所から労働安全衛生法違反により、それぞれ罰金20万円の略式命令を受け、令和６年５月10日にその刑が確定した。 このことが、建設業法第28条第１項第３号に該当すると認められる。
