株式会社北海大伸工業は、令和３年11月23日に一般国道229号乙部町館浦北応急復旧工事現場において、法定の除外事由がないにもかかわらず、法令の定める資格を有しない労働者に、最大積載量１１トンの不整地運搬車の運転業務に就かせた。 このことにより、令和５年６日27日に函館簡易裁判所において労働安全衛生法違反により同法人及び同法人役員が罰金刑を受け確定した。 このことは、建設業法第28条第１項第３号に該当すると認められる。
