上毛建設株式会社は、令和５年７月４日、利根郡みなかみ町内で施工された復旧治山事業において、同事業の安全管理及び施工管理を担当していた貴社の現場代理人が、車両系建設機械(ブレーカ)を用いて、関係請負人の代表者及び同人が雇用する労働者３名らとともに岩盤の掘削作業を行うに際し、運転中のブレーカに接触することにより危険が生じるおそれのある個所に、誘導者を配置する等の措置なく関係請負人の労働者(被災者)を立ち入らせた。これにより、被災者がブレーカのクローラに足を轢かれ、右足大腿部を切断するという労働災害を発生させた。 このことにより、同社は、労働安全衛生法及び労働安全衛生規則違反により書類送検され、沼田簡易裁判所から罰金２０万円の判決を受け、令和６年６月２９日に同判決が確定した。
