ＪＦＥエンジニアリング株式会社の元社員３名は、沖縄県竹富町の元町長等と共謀のうえ、沖縄県竹富町が平成２９年５月２６日に入札を執行した「竹富町東部第１区海底送水管更新工事（新城島～黒島）」及び令和２年５月２８日に入札を執行した「竹富海底送水管更新工事」の入札に関し、偽計を用いて入札等の公正を害すべき行為を行ったとして、令和４年８月１９日及び令和５年１０月２５日（令和６年１１月２８日控訴棄却）に那覇地方裁判所から官製談合防止法違反及び公契約関係競売等妨害罪により懲役１０カ月（執行猶予３年）及び懲役１年６ヶ月（執行猶予４年）の判決を受け、その刑が確定している。 このことが建設業法第２８条第１項第２号に該当すると認められる。
