千葉県市川市が令和２年４月２４日に入札を執行した「市川市立塩浜学園校舎等取壊し工事」において、株式会社淺沼組の元千葉営業所長は、工事の価格などの情報を事前に入手するなどして落札したことにより公正な入札を妨害したとして、令和５年３月９日に千葉地方裁判所において刑法第６０条及び刑法第９６条の６第１項違反により懲役１年６月（執行猶予３年）の判決を受け、その刑が確定している。 このことが、建設業法第２８条第１項第２号及び第３号に該当すると認められる。
