令和３年12月23日、株式会社藤幸組が元請として施工する現場（岐阜県安八郡輪之内町楡俣地内）において、当該現場の１次下請にあたる株式会社大晃の労働者Ｘの左手母指が骨折する労働災害が発生した。 当該労働災害の事実関係を把握するため、令和４年３月17日に岐阜労働局が株式会社藤幸組に対して臨検監督を行ったところ、上記工事現場の現場代理人である株式会社藤幸組の所属の現場代理人安藤大輔は、上記労働災害を隠蔽する目的で、令和３年12月23日は休工であった旨の虚偽の陳述をし、当該陳述に矛盾がないように偽装した現場作業日報及び点検簿の提示をしたもの。 令和４年12月15日に大垣簡易裁判所から違反業者に対し、罰金20万円、違反行為者に対し、罰金20万円の判決を受け、刑が確定した。 このことが、建設業法第28条第１項第３号に該当すると認められる。
