有限会社原ホームは、新潟県長岡市寺泊野積地内に所在する木造２階建ての建築物を解体する「医療法人恵愛会大島病院野積保養所解体工事」における一次下請負人である。 当該工事において、令和５年12月12日に有限会社原ホームの従業員Ａが、フレコンバックを解体用つかみ機のツメにかける作業を行っていたところ、同社従業員Ｂが解体用車両系建設機械の運転資格がないにもかかわらず、解体用つかみ機の運転業務を行い、運転操作を誤り、付近で作業を行っていた従業員Ａの頭部が解体用つかみ機のツメと建物の柱に挟まれ、従業員Ａが死亡する事案が発生した。 同工事の職長として現場に従事していた有限会社原ホームの従業員Ｃは、同社従業員Ｂに解体用つかみ機を使用させて作業を行うに当たり、あらかじめ、地形、地質の状態等の調査により適応する作業計画を定め、作業を行わさなければならないのに、これを定めず作業を行わせ、危険を防止するための必要な措置を講じなかった。 このことから、法人及び同社従業員Ｃが、労働安全衛生法違反により罰金刑（法人30万円、同社従業員30万円）に処され、令和６年10月29日にその刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
