株式会社双葉電気は、民間電気工事において、建設業法第３条第１項第２号に定める特定建設業の許可を有していないにもかかわらず、元請業者として同号の政令で定める金額以上の下請契約を締結した。このことが建設業法第１６条第１項に違反する。 また、同工事において、建設業法第７条第２号及び第２６条第３項の規定に違反して、営業所の専任技術者を当該現場の専任の主任技術者として配置した。 このことは、建設業法第２８条第１項本文に該当すると認められる。
