株式会社塩月工業が一次下請として請け負った島根県松江市に所在する島根原子力発電所における地盤改良工事において、労働者に鉄骨の撤去・搬出作業を行わせるに当たり、同労働者の頭上にある均しコンクリートが落下することにより、同労働者が死亡する事故が発生した。 この件について、労働者の労働災害を防止するための必要な措置を講じなかったとして、令和６年８月２７日に松江簡易裁判所より労働安全衛生法等違反で、同社及び同社現場代理人は略式命令（罰金刑）を受け、いずれもその刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
