有限会社浜名総業の役員等は、産業廃棄物である木くず等合計約39.7キログラムを、浜松市中央区湖東町3469番地の自社の資材置場で焼却したことにより起訴され、廃棄物の処理及び清掃に関する法律等に基づき、法人が罰金30万円、取締役が罰金30万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当すると認められる。
