当該建設業者は、大阪市内の民間発注の工事において、地鎮祭が行われるまで当該工事の注文者を発注者と誤認し、発注者から直接その建設工事を請け負った建設業法第３条第１項第２号に掲げる区分による許可を受けないで建設業を営む者と下請代金の額が同号の政令で定める金額以上となる下請契約を締結し、同法第22条第２項の規定に違反して、当該建設業を営む者で建設業者であるものから一括して建設工事を請け負った。
