ＩＨＩ運搬機械株式会社は他の事業者と共同して、建設業者が発注する、特定地下式ＰＳ設置工事及び特定エレベーター方式ＰＳ設置工事について、供給価格の低落防止等を図るため、供給予定者を決定し、供給予定者が供給できるようにすることにより、公共の利益に反して、特定地下式ＰＳ設置工事及び特定エレベーター方式ＰＳ設置工事の取引分野における競争を実質的に制限していた。この行為は私的独占の禁止及び公正取引の確保に関する法律第２条第６項に規定する不当な取引制限に該当し、同法第３条の規定に違反するものとされたが、公正取引委員会に自らその違反内容を報告したことから課徴金減免制度が適用され、令和７年３月２４日に公正取引委員会から同法第７条の４第７項に基づく通知を受けた。 このことが建設業法第２８条第１項第２号及び第３号に該当すると認められる。
