遠藤建設株式会社は、建設工事業を営み、同社が長野県大町建設事務所から請け負った令和６年度県単道路橋梁維持（災害関連）工事の現場において、施工及び安全管理を行う事業者である。同社の従業員であるＡは、現場代理人として同工事現場における安全管理等を行う者である。Ａは、一般県道宇留賀池田線内の同工事現場において、令和７年５月27日、労働者Ｂにドラグ・ショベルを使用して路肩の修繕作業を行わせるに当たり、当該箇所は工事のためにガードレールが取り外された路肩であり、同ドラグ・ショベルの転倒又は転落により労働者に危険が生ずるおそれがあったため、誘導者を配置し、その者に同ドラグ・ショベルを誘導させなければならないのに、事故発生時において誘導者による誘導がされず、もって機械等による危険を防止するため必要な措置を講じなかった。 このことにより、遠藤建設株式会社及びＡは労働安全衛生法等違反により、各々罰金20万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
