米山基礎工業株式会社の従業者として型枠の加工等を行うものが、同社の業務に関し、法定の除外事由がないのに、令和元年１０月３日午前９時頃から同日午前９時５７分頃までの間、成田市吉倉１６５番地１同社敷地内において、廃棄物である木くず等約３４．２キログラムを焼却したものである。 当該事実に基づき、佐倉簡易裁判所から令和２年９月８日付け令和２年（い）第２００号略式命令において、廃棄物の処理及び清掃に関する法律違反により、米山基礎工業株式会社が罰金５０万円の刑に処せられた。 このことが、法第２８条第１項第３号及び同条第３項に該当すると認められる。
