アカル工業株式会社の代表取締役は、同社の業務に関し、令和６年５月31日、津島市寺前町地内の津島労働基準監督署において、同署長に対し、真実は、同社の労働者が同年４月17日、名古屋市瑞穂区軍水町地内の解体工事現場において、解体作業に従事中、重機とブロック塀の間に挟まれたことにより、両側恥坐骨骨折等の傷害を負い、４日以上休業したのに、同人が、同日、同市南区加福本通付近路上において、停車中のトラックの荷台上でロープの締め具合を確認した際に、同荷台から落下して前記負傷を負った旨の虚偽の事実を記載した労働者死傷病報告書を、情を知らない税理士法人職員を介して提出し、もって労働基準監督署長に虚偽の報告をしたものである。 このことが、労働安全衛生法に違反し、津島簡易裁判所より、法人に対して罰金10万円、実行行為者である代表取締役に対して罰金10万円の略式命令を受け、その刑が確定した。 これは、建設業法第28条第１項第３号に該当する。
