On December 23, 2021, at a construction site in Niramachi, Rinko-cho, Anpachi-gun, Gifu Prefecture, where Fujiwara Corporation was the prime contractor, Worker X of Daiko Corporation, effectively, used a nylon sling to hoist a concrete waterway component. Worker Y of Daiko operated a crane-equipped drag shovel to lift the component, which then fell after the sling was released. Worker X's left thumb was caught between the fallen component and concrete materials placed nearby, resulting in an injury requiring approximately three months of rest. Regarding this occupational accident, Tomihiro Tominaga, the representative director of Daiko Corporation, submitted a false Worker Injury and Illness Report to Ogaki Labor Standards Inspection Office on December 28, 2021, claiming that the injured worker was in Daiko's warehouse rather than at the construction site, to avoid causing trouble for Fujiwara Corporation. 令和３年12月23日、株式会社藤幸組が元請として施工する現場（岐阜県安八郡輪之内町楡俣地内）において、事実上株式会社大晃の労働者Ｘがコンクリート製の水路の部材にナイロンスリングを用いて玉掛けをした後、当該部材を株式会社大晃の労働者Ｙがクレーン機能付きドラグ・ショベルを操作して吊り上げたところ、玉掛けが外れて当該部材が落下して倒れ、当該部材と倒れた方向に置いていたコンクリート製の材料との間に労働者Ｘの左手親指が挟まり、被災労働者は休業見込み３カ月を要する怪我を負った。当該労働災害に関し、株式会社大晃の代表取締役冨永智広は、元請である株式会社藤幸組に迷惑をかけたくないという理由から、自らの決定により、令和３年12月28日に、被災労働者が負傷した場所を上記工事現場ではなく株式会社大晃の敷地の倉庫内とした虚偽の内容の労働者死傷病報告書を大垣労働基準監督署に提出したもの。 令和４年12月７日に大垣簡易裁判所から違反業者に対し、罰金20万円、違反行為者に対し、罰金20万円の判決を受け、刑が確定した。 このことが、建設業法第28条第１項第３号に該当すると認められる。
