大阪市の発注する公共工事の請負契約に係る一般競争入札において、株式会社マルシン、学建工業株式会社、株式会社杉組、新虎興産株式会社、株式会社幸和組、株式会社伸和興業、株式会社岩本建材店、株式会社大朋建設、有限会社玉寄工業、西海金属株式会社、辰巳興業、株式会社渡邊商店、有限会社ダイナ建設、株式会社テイク、森下工業株式会社、大幸開発、株式会社ライト、山尾建設株式会社、晃新工業株式会社、株式会社倉本組、株式会社太志工業、株式会社フットワン、株式会社村山組、合建株式会社、株式会社ヤマシタ、網本工務店及び株式会社広正建設から、これらの者のICカードの名義人ではない行政書士（当該建設業者の入札担当者と同一人物）が依頼してこれらの者のICカードを同人が預かり、これらの者の入札について、工事費内訳書の作成と併せて電子入札に係るシステム入力による入札書の提出を行っていた。当該建設業者の入札担当者と同一人物が他者のICカードを預かるなどの行為は、入札の公正を害し、有資格者としてふさわしくない行為であったとして、このことにより、当該建設業者は、同市より、令和３年12月１日から翌年２月末日までの３か月の入札参加停止措置（大阪市入札参加停止措置要綱別表１４に該当）を受けた。
