長崎船舶装備株式会社が元請として請け負った長崎県長崎市に所在するマンション新築工事の現場において、二次下請業者の作業員が足場材の荷下ろし作業を行う際に墜落し負傷する事故が発生した。 この件について、労働者の労働災害を防止するため必要な措置を講じなかったとして、同社及び同社の社員一名が令和5年5月12日、長崎簡易裁判所より労働安全衛生法等違反でそれぞれ罰金20万円の略式命令を受け、いずれもその刑が確定している。 このことが、建設業法第28条第1項第3号に該当すると認められる。
