有限会社堀内工務店及び同社代表取締役は、北秋田市五味堀地内の屋根葺替え工事現場において、労働者に小屋屋根を作業床として、同屋根の葺替え作業を行わせるにあたり、同作業床の端は地上から約２．５４メートルの高さであり、墜落により労働者に危険を及ぼすおそれがあったにもかかわらず、同所に囲い等を設けず、労働者が墜落するおそれのある場所に係る危険を防止するために必要な措置を講じなかった。 これにより、同社及び同社代表取締役が労働安全衛生法違反の罪によりそれぞれ罰金２０万円の略式命令を受け、令和７年１月１１日までにその刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
