当該建設業者の取締役は、同社の業務に関し、令和３年３月23日大阪市所在の中学校プール設置その他工事現場内において、労働者が中学校校舎外部階段の２階の鉄骨部材を設置する作業中、足を滑らせて落下し、休業６日間を要する傷害を負い、４日以上休業することとなったのであるから、所轄の淀川労働基準監督署長に対し、遅滞なく労働者死傷病報告を提出して報告しなければならないのに、これをせず、もって法令の定める報告をしなかった。 このことで当該建設業者の取締役及び当該建設業者は、労働安全衛生法（昭和47年法律第57号）違反により、それぞれ罰金10万円の刑に処せられ、令和５年１月５日にその刑が確定した。
