当該建設業者は、京都府内の民間発注工事において、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括してアーク建設株式会社又は株式会社ハウスファクトリーに請け負わせた。 また、当該建設業者が当課へ提出した施工体制台帳及び施工体系図はアーク建設株式会社が記載されておらず、株式会社ハウスファクトリーの担当工事が仮設工事となっているなど、当該建設業者は、建設業法第24条の８第１項又は第４項の規定に違反して、施工体制台帳若しくは施工体系図を作成せず、又は虚偽の施工体制台帳若しくは施工体系図を作成した。
