西行建設株式会社が、二次下請負人として請け負った新潟県糸魚川市における新姫川第六発電所新設工事において、令和３年１月２８日に同社労働者が車両系建設機械から墜落する労働災害が発生した。この件について、真実の労働災害を秘匿し、上越労働基準監督署長に虚偽の報告書を提出したとして、同社及び同社社員1名が、令和４年２月２４日に高田簡易裁判所から労働安全衛生法違反による罰金刑の略式命令を受け、その刑が確定している。 このことが建設業法第２８条第１項第３号に該当すると認められる。
