中和建設工業株式会社の役員は，令和２年10月11日頃，山口県大島郡周防大島町所在の油田港油宇西Ａ防波堤灯台から真方位232度約925メートル付近海域において，廃棄物である廃スリーブ管等約67.674キログラムを投棄し，もってみだりに廃棄物を捨てた。 このことにより，同社の役員は，広島簡易裁判所から廃棄物の処理及び清掃に関する法律違反により，罰金30万円の略式命令を受け，令和３年６月21日にその刑が確定した。 このことが，建設業法第28条第１項第３号に該当すると認められる。
