株式会社明光社は、令和2年8月28日、山口県宇部市内の太陽光発電設備設置工事において、下請業者の作業員が作業中に誤って建物屋上から墜落し死亡する事故が発生し、同屋上に手すり等を設けず、労働者の労働災害を防止するために必要な措置を講じなかったとして、令和3年4月23日、同社及び同社社員が労働安全衛生法違反により、沼津簡易裁判所からそれぞれ罰金刑の略式命令を受け、その刑が確定している。このことが、建設業法第28条第1項第3号に該当する。
