萬屋建設株式会社が、注文者から元請として請け負った群馬県沼田市における新築建築工事において、令和７年３月１３日に労働者１名が、庇部分から墜落し負傷する事故が発生した。 この件について、労働者に庇部分を作業床として使用させ、養生シートを剥がす作業を行わせるに当たり、同所からの墜落により労働者に危険を及ぼすおそれがあったにもかかわらず、同所に囲い、手すり、覆い等を設けず、労働者の労働災害を防止するため必要な措置を講じなかったとして、令和７年１２月２５日、沼田簡易裁判所から同社及び同社の社員１名が労働安全衛生法違反で略式命令（いずれも罰金２０万円）を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
