当該建設業者は、岸和田市所在の病院増築工事を請け負っていたもの、Aは、当該建設業者の専務として同工事の施工及び労働者の安全管理を統括していたものであるが、当該建設業者の業務に関し、あらかじめ、土止め支保工を設け、防護網を張り、労働者の立入りを禁止する等危険を防止するための措置を講じなければならなかったのに、同措置を講じなかった。このことで、Aは、労働安全衛生法（昭和47年法律第57号）違反により、罰金30万円の刑に処せられ、令和５年４月19日にその刑が確定し、当該建設業者は、同法違反により、罰金30万円の刑に処せられ、同月18日にその刑が確定した。
