信濃建設工業株式会社が一次下請として請け負った東京都港区における地盤改良工事において、令和２年１２月１日、崩壊した舗装版と土砂に挟まれ、労働者３名が負傷する事故が発生した。 この件について、労働者に地山の明かり掘削作業を行わせるに当たり、地山の崩壊又は土石の落下により労働者に危険を及ぼすおそれがあったのに、あらかじめ土止め支保工を設けるなど当該危険を防止するための措置を講じず、もって掘削の業務における作業方法から生ずる危険を防止するため必要な措置を講じなかったとして、令和４年２月８日、同社が東京簡易裁判所より労働安全衛生法違反により略式命令（罰金２０万円）を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
