当該建設業者が民間の発注者と締結した山口県下関市内の太陽光発電システム（発電設備のほか、林地開発許可に基づいた造成等を含む。）に係る契約の建設工事は太陽光発電設備を設置するために森林を開墾する造成工事であるため、大雨であっても同工事の施工がなければ森林が防御壁等となって土砂災害の発生が抑制されることを踏まえ、同工事の施工にあたっては土砂災害防止のための十分な措置を講じる義務が当該建設業者にあるところ、当該建設業者は、同工事において、アーバンクラフト株式会社と下請契約を締結して工事を同社に施工させることにより、森林法（昭和26年法律第249号）第10条の２第４項の林地開発許可の許可条件に違反して、事業区域外の森林の伐採や形質の変更、残地森林地内の森林の伐採や形質の変更などを行ったことに加え、仮設防災施設の強化や沈砂池の設置などの土砂流出防止措置が不十分であったため、令和６年７月に、大雨に伴い、土砂が事業区域外に大量に流出し、近隣の田んぼや水路などに被害が及ぶなど、建設工事を適切に施工しなかったために公衆に危害を及ぼした。
