（株）ＮＩＰＰＯと密接な資本・人的関係にある系列プラント会社は、三次河川国道事務所発注の「令和４年度国道５４号上布野舗装修繕工事」（以下「当該工事」という。）において、アスファルト舗装工事に使用するアスファルト合材を当該工事の受注者に対し出荷していた。 当該工事においては、契約図書（特記仕様書、設計図面等）で「新規骨材によるアスファルト合材（新規アスファルト合材）の使用を指定」されており、受注者からも系列プラント会社に対し「新規骨材によるアスファルト合材（新規アスファルト合材）を指定」されていた。 （株）ＮＩＰＰＯの系列プラント会社は、当該工事におけるアスファルト合材の納入の際に、当該工事の受注者に対して、設計図書で指定された仕様のアスファルト合材である旨を報告していたが、今回、（株）ＮＩＰＰＯの調査において、設計図書とは異なる仕様のアスファルト合材を納入していた。
