及川竜也は，及川興業の名称で建設業を営んでいるところ，令和2年2月19日に登米市内の建設現場で倉庫兼車庫の屋根葺き作業を行わせるに当たり，墜落による労働者の危険を防止するため必要な措置を講じなかった。これにより，労働者を地面に転落させ，令和3年12月23日に登米簡易裁判所から，労働安全衛生法（昭和47年法律第57号）違反及び業務上過失傷害罪により罰金刑の略式命令を受け，その刑が確定した。 このことは，建設業法第28条第1項第3号に該当する。
