当該建設業者が請け負った令和２年度太田名部漁港水産流通基盤整備（北防波堤B）その２工事のうちコンクリートの嵩上げ工事において、当該業者の現場責任者であった外舘一富氏は、労働者にコンクリート打設用の型枠に設置された張り出し足場の解体作業を行わせるに当たり、墜落により危険を及ぼすおそれがあったにもかかわらず、作業労働者に要求性能墜落制止用器具を使用させる等の措置を講じなかったことにより、当該業者及び同氏が労働安全衛生法違反により罰金の略式命令を受け、その刑が確定している。このことが、建設業法第28条第１項第３号に該当すると認められる。
