建設業法第１７条の２による承継手続前の代表者が、その代表としての在職中に、虚偽の内容が記載された休業損害証明書等を作成するなどし、共犯者とともに人を欺いて財物を交付させた。 このことについて、奈良地方裁判所より刑法第２４６条（詐欺）の罪により懲役１年６月（執行猶予３年）の判決を受け、その刑が確定した。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
