当該建設業者は、自社が元請として請け負った東京都内の空調設備工事現場において、労働者が墜落するおそれのある場所に係る危険を防止するための必要な措置を講じなかった。これにより、令和４年３月１０日に作業員（下請負人の従業者）が高所から墜落し、その後死亡した。 この件について当該建設業者及び監理技術者等が、令和７年３月１９日付で東京簡易裁判所から、労働安全衛生法違反及び業務上過失致死によりそれぞれ罰金刑の略式命令を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
