当該建設業者の代表取締役（当時）は、山田町が令和３年11月17日に執行した入江田沼水辺公園芝張整備工事（土木工事）の条件付一般競争入札に関して、山田町職員（当時）から、予定価格と同額である設計額の教示を受け、㈱堀合建設に同予定価格に近接する金額で入札させて同案件を落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為を行った。これにより、令和５年９月４日に盛岡地方裁判所から、懲役１年２月、執行猶予３年の判決を受け、その刑が確定している。 このことが、建設業法第28条第１項第２号及び第３号に該当すると認められる。
