村上建設株式会社は，令和６年４月15日，鹿児島県奄美市名瀬大字大熊所在の大熊漁港において，同社が所有する船舶を同社従業員が洗浄した際に，洗浄水に混入した燃料油を過失により同漁港海域に排出させた。 この件について，「海洋汚染等及び海上災害の防止に関する法律」違反により名瀬簡易裁判所から罰金刑の略式命令を受け，令和７年１月15日にその刑が確定した。 このことは，建設業法第28条第１項第３号に該当する。
