当該建設業者は、他の建設業者から請け負った兵庫県内の公共工事において、営業所における専任の技術者が主任技術者としての資格を有することを証する書類として、同人の第一種電気工事士免状及び健康保険被保険者証の写しを注文者側に提出し、同人が主任技術者である旨の建設業法第24条の８第２項の規定に基づく通知（再下請負通知）を行うなど、同法第26条第３項の規定に違反して、同法第７条第２号に規定する同社の営業所における専任の技術者である同人を、専任を要する主任技術者として工事現場に配置した。
