１ 当該建設業者は、大阪市発注のＡ工事において、建設業法第22条第２項の規定に違反して、株式会社渡辺塗装から同社の請け負った建設工事を一括して請け負った。 ２ （１）当該建設業者は、大阪市発注のＢ工事において、建設業法第22条第２項の規定に違反して、株式会社渡辺塗装から同社の請け負った建設工事を一括して請け負った。 （２）当該建設業者は、Ｂ工事において、建設業法第26条第３項の規定に違反して、他の工事現場に専任の主任技術者として配置されていたＣ氏を専任の主任技術者として配置するなど適格な主任技術者を配置しないなど（また、Ｃ氏は工期の後半には他の工事現場の現場代理人でもあった）、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して株式会社ケイテックに請け負わせた。
